These Terms & Conditions (“Terms”) govern your access to and use of the Nona mobile application and related services (the “Service”), operated by Nona (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
Nona is a baby care companion that lets parents and caregivers log and review feedings, sleep, diaper changes, medicine, vaccinations, and growth measurements, view timelines and insights, receive daily tips, and share access with other caregivers.
2. Eligibility and Accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity that occurs under your account.
- You confirm that you are the parent or legal guardian of any baby whose profile you create, or that you have that person’s permission to record information about their child.
- Notify us promptly at support@nonathebaby.app if you suspect unauthorized use of your account.
3. Family Sharing and Caregiver Access
- You may invite other caregivers (for example, a partner, grandparent, or nanny) to join your family group. You decide the role and access level each caregiver receives.
- You are responsible for the people you invite. Only invite caregivers you trust to view and, depending on their role, add or edit your baby’s information.
- Caregivers must use the Service in accordance with these Terms. You can remove a caregiver’s access at any time in the app.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose;
- Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems;
- Interfere with or disrupt the Service, including by transmitting malware or placing unreasonable load on our infrastructure;
- Reverse engineer, decompile, or copy the Service except as permitted by law;
- Upload content that is unlawful, harmful, or infringes the rights of others.
5. Your Content
You retain ownership of the information you add to the Service, including baby profiles, care logs, and photos (“Your Content”). You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and improve the Service — for example, to sync data between your devices and your invited caregivers, and to generate the timelines and insights the app shows you.
You are responsible for the accuracy of Your Content. You can edit or delete it at any time in the app.
6. Medical Disclaimer
The Service does not provide medical advice, diagnosis, or treatment. Content in the app — including daily tips, growth information, vaccination schedules, and pattern-based insights — is provided for informational and organizational purposes only and is not a substitute for professional medical advice. Never disregard or delay seeking professional advice because of something you read in the app. Your use of any information provided by the Service is solely at your own risk.
7. Intellectual Property
The Service, including its design, logos, text, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial use.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
9. Availability and Changes to the Service
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. We may add, change, or remove features, or suspend or discontinue the Service (in whole or in part) at any time. Where reasonably possible, we will give you advance notice of material changes.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends, and your data will be handled as described in our Privacy Policy.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the insights or reminders provided by the Service will be accurate, complete, or timely.
12. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or the Service will not exceed the greater of the amount you paid us in the twelve months before the claim arose or fifty (50) US dollars.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including certain consumer protection rights.
13. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service or violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which Nona is established, without regard to conflict-of-law principles. Mandatory consumer protection laws of your country of residence remain unaffected.
